What is the Ontario N11?
The N11 form, known as an Agreement to End the Tenancy, is a standardized document used to mutually terminate a tenancy agreement between a landlord and a tenant. It outlines the terms under which both parties agree to terminate the tenancy. This form is legally binding once signed by both parties.
How is the N11 Currently Being Used?
In the province of Ontario, at the end of a fixed-term lease, the lease goes month to month and tenants are not required to sign a new lease if they want to stay. When the tenant is ready to move out, they are required to provide a minimum of 60 days’ notice to the landlord by completing and submitting an N9 Form.
As a result of this, some landlords are using the N11 as a tactic to force tenants to sign a new lease as opposed to them not signing a new lease and having their current lease go month to month.
Some tenants have reported feeling pressured or misled into signing the form, unaware of their rights or alternatives. It's crucial for students to be aware of their rights surrounding the use of the N11 form.
Where Should Students Look Out for the N11 Form?
You may encounter the N11 form during discussions about ending your tenancy. Any time you are presented with a document to sign from your landlord, it’s important to carefully read and review it and to seek clarification if needed. Some landlords will ask tenants to sign an N11 form when signing your lease. An N11 is an agreement to terminate at the end of the lease term. A landlord cannot require the tenant to sign an N11 as a condition of agreeing to rent a unit. A tenant does not have to move out based on the signed N11 if the landlord required the tenant to sign it as a condition of their tenancy.
